In Roquetes, Baix Ebre, a flat owner can recover her property for personal use after the Provincial Court of Tarragona upheld an earlier ruling in her favour. The decision confirms the judgment first issued by Court of First Instance number 1 of Tortosa.

The court said the owner had the right to reclaim the flat for her own occupation, even though the tenants opposed leaving. It also ruled that she did not have to give detailed reasons for the claim in the burofax sent to the tenants.

The case turned on a clause in the rental contract that allowed the owner to recover the property, a provision supported by Spain's Urban Leases Act. The court said that contractual term, together with the legal framework, backed the landlord's position.

The Urban Leases Act, or Ley de Arrendamientos Urbanos, includes provisions that can allow landlords to recover a property in specific cases, usually for their own use or for close family members. In this case, the Tarragona court said the contract clause was a key factor in the outcome.
