The High Court of Justice of Catalonia (TSJC) has annulled six penalties worth a combined €547,520 against Cabify and three companies linked to its private-hire vehicle, or VTC, driver network. The ruling means the companies do not currently have to pay the fines imposed over an alleged illegal transfer of workers.

For Cabify’s VTC partners operating in the Barcelona area, the immediate consequence is that the six sanctions have been set aside. The case concerns Labour Inspectorate proceedings notified to the companies in March 2021.

According to reporting by ACN, the TSJC found that the Generalitat’s Labour Inspectorate had exceeded the maximum legal time limit for completing the proceedings.

The Department of Business and Labour sent the infringement notices and the decision ending the sanction process 17 days after the permitted deadline, according to reporting by Europa Press.

Department examines the judgment

The Department of Business and Labour, the Generalitat department responsible for the Labour Inspectorate, has received the judgment and is examining it, sources told Europa Press.

The department has not announced its next procedural step. The TSJC decision currently removes the payment obligation arising from these six notices.
