The High Court of Justice of Catalonia (TSJC) has confirmed the annulment of building licences granted by Vallcebre Town Council in Berguedà. These licences were for the reconstruction of the Cal Pecunya farmhouse, located in the municipality.
The ruling, issued on 25 February by the Administrative Disputes Chamber, Second Section, dismisses an appeal filed by the council. This appeal challenged an earlier resolution from Barcelona's Administrative Disputes Court number 12, which had sided with the Vallcebre Residents' Association. The association had initially reported the irregularities.
Court Upholds Residents' Complaint
This latest decision means the court has again supported the residents' complaint regarding the building work on non-urbanisable land. The initial court ruling in Barcelona had already found in favour of the residents, prompting the town council's appeal to the TSJC.
The case highlights the importance of adhering to planning regulations, especially concerning construction in protected or non-urbanisable areas. The Vallcebre Residents' Association's persistence in pursuing the complaint has been key to the outcome.
