A judge in Granollers is processing a second complaint against F. J. M. M., a sargeant with the Montornès del Vallès Local Police, for alleged falsification in the transcription of a telephone call received at the station. This transcription was reportedly used to open a disciplinary file against the affected police officer, according to documentation seen by El Periódico.
This marks the second judicial process for the police commander. He is already facing a separate complaint of alleged harassment from another subordinate, a corporal. That case, initially closed, was reopened on 23 February by the Audiencia de Barcelona, which stated there were "indications" that "acts against moral integrity may have occurred."
The new complaint was filed almost a year ago but was admitted by the Granollers judge on 17 November 2025. The magistrate agreed to initiate judicial proceedings for a crime of falsification. To verify the claims, the judge ordered the agent and the sargeant to be called for declarations and requested the disciplinary file from Montornès del Vallès Council, which has also been appealed in the contentious-administrative jurisdiction. Legal sources confirmed that this documentation has now been delivered to the court.
Notably, the complaining agent is proposed as a witness in the first judicial process against the sargeant.
Allegations of False Transcription
The complaint, signed by lawyer Iván Bayo Roque, states that on 13 March 2024, the agent received a call at the Local Police station from a citizen. The caller was enquiring about a report she had filed regarding the loss of her children's ID cards, which she claimed was not on record. This conversation was recorded and later transcribed at the request of the Local Police chief inspector.
This transcription was then used as "incriminating evidence" in the disciplinary file, which resulted in the local police officer being suspended from duty for one and a half months, with a loss of pay. The complaint argues that the transcription included in the file "does not correspond to the reality of the facts," as it "deliberately" omits part of the conversation that the prosecution considers "highly relevant."
Specifically, the transcription does not include a section of the recording where an agent on street duty calls via police radio, asking their colleague for information about a citizen. It also fails to show how the complainant spoke with a third person, which led her to interrupt and put the conversation about the lost ID cards on hold at the beginning. The complaint therefore asserts that the transcription "is untruthful" because it was incomplete. According to the lawyer, these facts could constitute a crime of documentary falsification.
Council's Response and Opposition's Criticism
Following El Periódico's publication of the first judicial process against the Local Police sargeant, Montornès del Vallès Council blamed the corporal who filed that complaint. The council accused her of showing "resistance to change" and "continuous questioning" of the department's leadership. The local authority suggested the initial criminal complaint was part of a "possible concerted action among a group of workers aimed at discrediting, defaming, and disparaging the body's leadership," attributing "alleged bad faith" to these workers. The municipal opposition, for its part, collectively criticised the local government, which is led by a Comuns mayor.
As of now, neither the complainant nor the sargeant has given a statement in the new case, due to the backlog in the Granollers courts. The legal proceedings are expected to continue as the court works through its schedule.
