This ruling overturns a previous decision by an instruction court, which had initially dismissed the complaint.
The court's decision means a formal complaint regarding the incident will now be processed. The original complaint alleged that police used pepper spray against demonstrators during the protest.

Critics argue that the initial dismissal of such complaints creates a barrier for citizens seeking to defend their fundamental rights. "This constant effort, of rowing against the opacity of the administration, constitutes a disincentive for the population in the claim and defence of their fundamental rights, while also providing constant protection for impunity and the facilitation of police abuse," a statement from those involved in the complaint said.
The investigation will look at the specific circumstances of the pepper spray use and whether it was proportionate to the situation. The outcome could influence future police crowd control tactics in Catalonia.
